Spain approves law allowing alcohol tests for minors
The new legislation empowers authorities to carry out breathalyser tests in schools and other places where alcohol consumption is prohibited

One of the most notable features of the new law is the authorisation for police and security forces to conduct breathalyser tests on both minors and adults in locations where alcohol consumption is prohibited. This includes schools and areas dedicated to public performances. The tests will be non-invasive and can be repeated if requested by the individual being tested.
In cases where a minor offence is committed related to alcohol consumption, the law offers an alternative sanction to fines: participation in preventive awareness programs or rehabilitation depending on the individual case. These measures are part of a broader initiative to delay the initiation of alcohol consumption and reduce harmful binge drinking among young people.
Expanded alcohol restrictions
The law extends alcohol prohibitions to a variety of public spaces, including:
- Educational centres: Alcohol consumption is banned in pre-schools, primary, secondary schools and vocational training centres, with universities being the only exception.
- Child protection and student residences: Alcohol will also be prohibited in residences housing minors and in child protection centres.
- Sports and leisure centres: In venues designed for minors, such as sports and leisure centres, the consumption of alcohol will be strictly banned.
Spain’s Minister for Health Mónica García stressed the importance of the legislation, stating, "There is no safe amount of alcohol of any kind that doesn’t have a negative impact on health. We need to banish from our imagination this deep-rooted and unscientific idea that there may be some health benefits with moderate consumption."
Tighter advertising and commercial restrictions
In an effort to curb alcohol’s appeal to minors, the new law also places strict limits on alcohol advertising:
- Proximity to educational institutions: Advertisements for alcoholic beverages will be banned within 150 metres of schools, healthcare centres, social services and children’s parks.
- Targeted advertising: The law prohibits advertising that targets minors, including the use of young models or characters under 21 years old, and bans the portrayal of pregnant women or foetuses in alcohol-related ads.
Additionally, alcohol will no longer be allowed in vending machines near schools, and self-service establishments will be required to limit alcohol display areas to designated sections, separate from those aimed at minors.
The legislation also proposes incorporating alcohol consumption records into medical histories, especially in cases where minors seek treatment for alcohol-related incidents. If a minor is treated for alcohol poisoning, a comprehensive evaluation involving the minor’s parents will be mandatory.
The draft law is part of a wider effort to harmonise existing regional and municipal laws and is expected to undergo further parliamentary review. If approved, it will set a unified framework for tackling underage drinking across Spain, ensuring better protection for minors and promoting healthier behaviours.
The measures aim to not only deter early alcohol consumption but to build a robust support system through education and awareness programs for both families and communities.
