ARCHIVED - Case against man who helped wife to die withdrawn as new Spanish euthanasia law takes effect
Spain became the seventh country in the world to legalise euthanasia when the new law came into effect last Friday (25 June).
The Public Prosecutor’s Office in Madrid has officially withdrawn its accusation against Ángel Hérnandez, who helped his wife María José Carrasco to die in April 2019.
María José was a terminal multiple sclerosis patient who had been fighting for the right to end her suffering to no avail. After her death, which was taped to ensure that there was evidence of her wish and consent, her husband faced a series of accusations with the Public Prosecutor eventually requesting a six-month jail sentence for aiding and abetting suicide.
The matter sparked public outrage and thousands of citizens signed petitions, forcing the authorities to put proposals for a euthanasia law back on the table.
Now, with the law finally approved and in force, the Public Prosecutor has filed a writ with the court to withdraw its accusation in retroactive application of changes to the Penal Code.
In this particular case, the official body determined, the procedure for assisted euthanasia would have been activated, meaning Hernández’s actions in helping his wife to end her life would have been legal.
