ARCHIVED - Spain proposes new anti-corruption laws: up to 3 years in prison for crooked politicians
The Spanish government wants to jail public officials in possession of more than 250,000 euros that cannot be accounted for
Spain’s government is registering its intent to make a new amendment in the reform of the country’s Penal Code which would mean prison for public officials who are in possession of more than 250,000 euros that cannot be justified.
The text is being processed in the Congress of Deputies with the intention of creating a new crime of ‘illicit enrichment of public officials’.
The penalties for this offence could be up to three years in prison and will be aimed at those who are unable to justify assets in excess of a quarter of a million euros. For a period of up to five years after holding office, any politician or public official who “has obtained an increase in assets or a cancellation of obligations or debts for a value of more than 250,000 euros in relation to their accredited income” will be “punished with prison sentences of between six months and three years”, according to the draft text of the amendment.
Any offending party who “openly refuses to duly comply with the requests of the competent bodies to verify their justification” would also have to pay a fine and would be disqualified from holding public employment and office.
It remains to be seen how far through Congress this new proposal will make it and to what extent it will be watered down.
