ARCHIVED - Illegal whiskey worth 20,000 euros being sold in Elche shop
The Elche store owner was selling high quality bottles of spirits without the corresponding tax seals
A shop owner in Elche is under investigation after police discovered 59 illegal bottles of high-end whiskey, including one worth more than 20,000 euros, all of which lacked the appropriate labelling and tax seals.
A routine search of a warehouse in the name of the Chinese store owner was carried out on March 3, when the Guardia Civil stumbled on the spirits, and seized all of the bottles worth tens of thousands of euros in accordance with Law 38/1992 on Excise Duties.
The search was part of the Guardia's "intensification of controls against counterfeiting, sale, labelling, trade, illegal distribution, adulteration of food products and economic fraud" that is being carried out across Spain.
"The objective is the exhaustive control of compliance with both national and European regulations on food safety, as well as the respect of all legal conditions," according to police sources.
A police report has been sent to the Customs and Excise Administration of Alicante, part of the Tax Agency, which will analyse the bottles of whisky and begin proceedings for the alleged case of administrative infringement of smuggling.
The Law on Excise Duties classifies the possession of more than 10 litres of beverages for commercial purposes without tax stamps/seals as a tax offence, which is punishable by a proportional fine of 10% of the value of the products in circulation, with a minimum of 600 euros for each offence.
The tax seal is attached to the bottle lid so that it cannot be opened for the "purpose of adulterating its composition and as a guarantee that its distribution and trade is governed within the margins of legality and that it meets all quality requirements".
The National Currency and Stamp Factory (Fábrica Nacional de Moneda y Timbre) is responsible for the production of tax stamps as a security measure against possible counterfeiting in Spain, and there are currently seals for alcoholic beverages and tobacco.
