ARCHIVED - Foreigners who enroll in a Vocational Training course in Spain will be granted temporary residency
Non-nationals living irregularly in Spain should be able to sign up for the 2023-2024 academic year
Foreigners living in irregular situations in Spain will soon be offered temporary residency provided they have been living here for two years and enroll in a Vocational Training (FP) course.
The details are still being ironed out between education heads and the Ministry of Education, but the plan is to have the new legislation approved by May so that students can sign up for the 2023-2024 academic year. To be eligible, foreigners will have to meet certain other criteria specific to their course, such as being proficient in Spanish.
Specifically, the Vocational Training Regulation establishes that "all citizens of countries not belonging to the European Union who, while in Spain, have remained continuously for two years, will obtain authorisation for the registration and completion of a training of the degrees of the professional training system".
The temporary permit will remain valid for the duration of the course but if the student receives a job offer at the end, they will also be permitted to apply for a two-year residency in Spain.
While the law reform is primarily aimed at helping the enormous irregular immigrant population in Spain, there is also a secondary benefit for the government, which hopes to train up foreigners for the jobs in which there is a serious shortage in this country. The move follows a reform of the Immigration Law proposed last year which will make it easier for skilled irregular immigrants obtain work permits.
Aside from living in Spain for the past two years, prospective students must not have a criminal record from the last five years; they will be granted residency for an initial 12 month period, which can be extended by a further year if the course runs longer, but students must begin their professional qualification training within three months after being granted the permit.
