Many people, when they come to buy a house in Spain, do so through a real estate agent, which is a great way to get expert local knowledge, and there are loads of estate agents out there who speak different languages – not just Spanish – and are in fact expats themselves who have moved over to Spain from their home country.
But the mistake a lot of foreign buyers make is using the lawyer recommended by the estate agency. It may seem convenient, but it can lead to significant issues down the road. That’s because these lawyers often prioritise their long-term working relationship with the agency over your best interests as a buyer.
For that reason, when purchasing property in Spain, it’s crucial to select an independent lawyer, free from any conflicts of interest.
How to choose the right lawyer for your Spanish property purchase
There are 3 main ways to find a lawyer in Spain to suit your needs:
- Select a local law firm from a reputable business directory database
- Check on a ‘College of Lawyers’ list for the autonomous community you are looking to buy in
- Talk to people who have already been through the process and get their advice on what lawyers to use and which ones to avoid
If an estate agent insists you use their recommended lawyer, it’s a good reason to be extra cautious and consider alternatives. Your property purchase deserves the right legal protection.
