French men avoid jail after sexually assaulting British tourist in Spain
The young woman was attacked while holidaying in Ibiza back in 2016
Two French citizens have been sentenced to two years in prison each for assaulting a British tourist who was on vacation in Ibiza in June 2016. The Second Section of the Provincial Court of the Balearic Islands concluded the trial on Monday March 4, where the defence and prosecution reached an agreement.
However, despite accepting guilt, the pair won’t face a single day behind bars as long as they adhere to some court-ordered conditions.
According to local reports, the two men, who were staying in an apartment in Playa d'en Bossa, invited several girls to join them for drinks on the terrace. After consuming alcohol, two of the women went to the bathroom, leaving the victim alone with one of the defendants. The second suspect then entered the room and both men sexually abused the Briton orally and vaginally, while she repeatedly asked them to stop.
The Prosecutor’s Office initially sought a 20-year prison term, but due to the mitigating circumstance of undue delays, the request was reduced. The defendants have acknowledged the facts as part of the agreement with the Prosecutor’s Office. In addition to the prison sentence, they will also be subject to a seven year restraining order.
In a very unusual move, the victim has waived the proposed compensation of 10,000 euros suggested by the prosecution.
Controversially, the convicted abusers will not serve their sentences immediately, as they have been granted a three-year suspension of their sentence. This is conditional upon their participation in a sexual education course.
These legal proceedings raise serious questions about the effectiveness of the judicial system in Spain in addressing sexual assault cases and the role of plea bargaining in achieving justice for victims. The case highlights the obstacles that victims face in navigating the legal system and the broader social implications of sexual violence, and the topic is especially poignant with International Women’s Day just around the corner.
