ARCHIVED - Patient who assaulted an Orihuela GP over a prescription is jailed for 4 months
A court in the Vega Baja town, Alicante province, also imposed a restraining order
A female patient who attacked a family doctor at an Orihuela health centre after he refused to give her a prescription has been sentenced to four months in prison together with a restraining order and a year-long ban from communicating with the GP.
The incident happened on August 26 when, according to the College of Doctors of Alicante (COMA) which provided legal assistance to the doctor, the patient visited the clinic for a new prescription.
When the request was refused, the woman "became aggressive and began to insult the doctor", Orihuela Court of Instruction heard. She then threw a protective screen at him and a blood pressure monitor. "The latter did not hit him because he had covered himself with the previous protective screen", it was added.
The doctor reported the assault to the National Police and contacted COMA which offers free legal representation to members.
An initial sentence of six months imprisonment for assault was reduced to four months as "a result of the defendant's acquiescence to the requests of the public prosecutor and COMA". However, the woman must keep a 300 metre distance from the GP's place of work and home and is prohibited from having any communication with him for 12 months.
"We must make the problem visible and raise awareness among the public and even among doctors themselves in order to fight against aggression; we cannot allow assaults to go unpunished; every aggression must be reported," said COMA secretary general Dr. José Manuel Peris.
Peris also urged his colleagues to contact COMA if they are ever assaulted. "We are here to protect and defend you. In the face of insults, threats and aggression, we will act without hesitation. Tolerance must always be zero," he said.
