ARCHIVED - DGT quashes speeding fines on the N-332 Orihuela Costa over unreliable radar
Taxi drivers in the Vega Baja area of Alicante province have claimed for months that signage in the area is flawed
Spain's Directorate General of Traffic (DGT) has been forced to cancel dozens of fines issued to alleged speeding motorists caught by what has now been deemed an unreliable radar on the N-332 in Campoamor, Orihuela Costa, and removed the speed camera altogether.
For months, taxi drivers and other motorists have been complaining that signage in the area, where there are actually two radars, is flawed and confusing. They claim one sign on the stretch of motorway shows the end of 70km/hr zone, but with a double lane and a 1.5-metre hard shoulder on both sides, it's easy to believe the speed limit here is 100km/hr. It is actually 80km/hr, so scores of drivers have been penalised for exceeding the limit.
José Miguel Sánchez Flores has worked on Orihuela coast as a taxi driver since 1999, and since September of this year alone, has appealed against five fines, each for 100 euros. Following a DGT probe, the fines have all been quashed.
In a letter to Sánchez Flores, the traffic authority wrote: "The dismissal of the fines is agreed without any declaration of liability over a lack of sufficient accreditation of the facts constituting the alleged infringement."
And according to the taxi driver, he is aware of colleagues and Orihuela Costa residents who have also had their fines shelved. The DGT has also advised that motorists who have already paid fines can claim a refund.
The speed camera in question has now been removed, although the DGT claims this is also due to the fact it was being vandalised on an almost daily basis due to its close proximity to the roadside and cycle path.
